Under current Michigan law, not all crimes can be expunged from a criminal record. Crimes carrying a maximum penalty of life in prison cannot be removed from a criminal record. Misdemeanor drunk driving crimes are also ineligible for expungement in Michigan.

Even if your conviction is eligible for an expungement, under new Michigan law, an individual must wait five years from the time they are released from incarceration, or discharged from probation (whichever is later), before they are eligible to apply for an expungement in Michigan. This means after five years of completing your sentence for the conviction you want to expunge, you can apply to have your conviction set aside.
