Under new Michigan law, an individual may expunge one felony or up to two misdemeanor convictions from their criminal record. In order to get an expungement in Michigan, you must file an application to set aside your conviction. After filing the application and verifying your expungement eligibility, a hearing will be held where a judge will decide whether or not to grant your application.

It is important to know that if a judge denies an individual’s application to set aside their conviction, they must wait three (3) years before they can apply for a set aside again. This means if you apply for expungement and the judge denies your application, you will not be able to clear your criminal record for at least three more years. Having an attorney represent you in an expungement can greatly increase your chances of having your application granted.
